Terms & Conditions

These Terms & Conditions explain how saifulasif.com and the professional services provided by Saiful Asif work.

My goal is to keep projects clear, transparent, and fair for both clients and the developer.

Client Protection Summary

I want every client to know exactly how working with me works. Clear expectations protect both parties and foster successful, long-term technical collaborations.

50% TO START

A 50% advance payment is required before project work begins.

50% AFTER COMPLETION

The remaining 50% is payable after the agreed work has been completed.

14-DAY VERIFICATION

You have 14 calendar days after completion to report issues directly related to the agreed work.

RESOLUTION COMMITMENT

If I am unable to resolve the specific technical problem agreed in the project scope despite reasonable efforts, you may request a refund of the payment made for that unresolved Service, subject to these Terms and applicable exclusions.

CLEAR SCOPE

Additional work or new requirements are discussed before additional charges are incurred whenever reasonably possible.

NO UNREALISTIC PROMISES

If a problem depends on a hosting provider, payment provider, third-party software, or another external factor, I will explain that rather than promise something outside my control.

1. About These Terms

Welcome to saifulasif.com (“Website”), operated by Saiful Asif (“Saiful Asif,” “I,” “me,” “my,” or “Service Provider”).

These Terms & Conditions (“Terms”) govern your access to and use of this Website and your purchase or use of any services provided through or in connection with the Website.

These Terms apply to all services, projects, consultations, technical work, digital deliverables, and other professional services provided through saifulasif.com.

By using this Website, submitting an inquiry, requesting a quotation, accepting a proposal, making a payment, or engaging my Services, you acknowledge that you have read and agree to these Terms.

If you do not agree with these Terms, please do not use the Website or purchase my Services.

The Website and Services are operated under my professional name and are not intended to represent a separate agency or company unless explicitly stated otherwise in a written agreement.

The exact Services provided for a particular client will be determined by the applicable proposal, quotation, statement of work, invoice, or written agreement.

4. Project Scope

Before starting a paid project, the scope of work should be established clearly.

The agreed scope may include:

  • Required functionality
  • Design requirements
  • Development requirements
  • Number of pages
  • Integrations
  • Technical requirements
  • Deliverables
  • Estimated timeline
  • Project price
  • Payment schedule
  • Revision arrangements
  • Other project-specific requirements

Work that is not included in the agreed scope may require an additional fee.

Significant changes to the original requirements may affect the project price or timeline. Whenever reasonably possible, I will communicate such changes before performing additional chargeable work.

5. Quotes and Proposals

Quotes, estimates and proposals are prepared using the information available at the time.

An estimate may change if:

  • Requirements change
  • New functionality is requested
  • Existing technical problems are discovered
  • Third-party limitations arise
  • Required access is unavailable
  • The existing website differs materially from the information provided
  • Additional development becomes necessary

Unless specifically stated otherwise, an estimate does not guarantee a fixed completion date.

A proposal becomes applicable to a project once it has been accepted according to the terms communicated with that proposal.

6. Payment Terms

Standard Payment Structure
50% ADVANCE PAYMENT

A 50% advance payment is required before work begins. The advance payment allows me to reserve the required time for the project and begin the agreed work.

50% FINAL PAYMENT

The remaining 50% is payable after the agreed work has been completed and the agreed deliverables are ready for client review or handover.

Example: For a $1,000 project → $500 before work begins, and $500 after the agreed work is completed.

For larger or longer projects, milestone-based payments may be used if agreed in writing.

7. Payment Safety

I want clients to have a clear understanding of what they are paying for before work begins.

Before starting a project, the client should have access to:

  • Project scope
  • Price
  • Payment terms
  • Expected deliverables
  • Important limitations
  • Other relevant project conditions

Where payment is processed through a third-party platform, that platform's own payment, dispute, refund and buyer-protection policies may also apply.

Financial Security Notice: Clients should never send unnecessary sensitive financial information such as banking passwords, card PINs, full payment-card credentials, or online banking login credentials.

8. Client Protection & Resolution Policy

I want clients to feel comfortable when hiring me.

• 50% to start.
• 50% after completion.
• 14 days to verify the completed work.

For eligible problem-solving Services, if I am unable to resolve the specific technical problem expressly agreed in the project scope, despite making reasonable efforts, the client may request a refund of the payment made for that unresolved Service, subject to these Terms and the applicable project agreement.

This policy is intended to provide a fair resolution for both the client and the developer. It does not constitute an unconditional guarantee that every technical issue can be resolved regardless of its cause or circumstances.

9. 14-Day Verification Period

After completion of the agreed work, the client has 14 calendar days to review and test the delivered work.

If the client identifies a problem that:

  1. Relates directly to the agreed work; and
  2. Was not functioning as agreed when the work was delivered,

the client should notify me within the 14-day period. Where the issue falls within the original scope, I will review and, where appropriate, correct the issue without additional development charges.

10. What the 14-Day Period Does Not Cover

The 14-day verification period is not an unlimited revision or development period.

It does not automatically include:

• New features
• New pages
• New designs
• New integrations
• New functionality
• New content
• New business requirements
• Additional customization
• Changes requested after approval
• Problems caused by third-party changes
• Changes made by another developer
• Changes made by the client

Such work may require a separate quotation.

11. Refund & Resolution Policy

If I am unable to resolve the specific problem that was expressly agreed as the subject of the Service, despite reasonable technical efforts, the client may request a refund in accordance with the applicable project agreement and these Terms.

Where a Service has been partially completed, the appropriate refund amount may depend on:

  • Work already completed
  • Deliverables already provided
  • The agreed scope
  • Third-party costs
  • Whether the unresolved portion was within my reasonable control

Any approved refund will normally be returned through the original payment method where reasonably possible.

12. Situations Where the Resolution or Refund Policy May Not Apply

A refund or resolution commitment does not automatically apply where the requested result is prevented by circumstances outside my reasonable control, including:

• Hosting-provider failures
• Payment-provider failures
• Third-party API failures
• Domain-provider issues
• DNS-provider issues
• CDN outages
• Third-party software failures
• Unsupported plugins
• Unsupported themes
• Expired licenses
• Missing access
• Incorrect credentials
• Client refusal to provide required access
• Client-provided code causing the problem
• Problems caused by another developer
• Client changes to the website
• Changes in project requirements
• Permanent data loss existing before involvement
• Third-party account restrictions
• Legal or regulatory restrictions
• External infrastructure failures

Where possible, I will explain the cause and recommend an appropriate next step.

13. Client Responsibilities

Clients are responsible for providing accurate information and reasonable cooperation required to complete the project.

This may include providing:

  • Website access
  • WordPress access
  • Hosting access
  • SFTP/FTP access
  • Database access
  • Domain/DNS access
  • API credentials
  • Plugin licenses
  • Theme licenses
  • Payment gateway access
  • Content
  • Images
  • Branding materials
  • Technical requirements
  • Timely feedback

The client confirms that they have appropriate authority to provide access to the website, systems, accounts, data and materials supplied for the project.

14. Website Access & Credentials

Where access is required, clients should provide the minimum level of access reasonably necessary. Temporary or limited-access accounts are recommended where available.

Clients remain responsible for:

  • Their accounts
  • Passwords
  • Hosting accounts
  • Domain accounts
  • Payment accounts
  • Email accounts
  • Third-party services

After completion of the project, clients are encouraged to revoke temporary access or change credentials where appropriate.

15. Backups & Data Protection

Clients are strongly encouraged to maintain current backups before significant changes are made to a website. Where a backup is available, it may provide an additional recovery option if something unexpected occurs.

Unless backup and restoration are expressly included in the project scope, the client remains responsible for maintaining independent backups.

This is particularly important for:

  • Production websites
  • Databases
  • WooCommerce stores
  • Large websites
  • Hacked websites
  • Server migrations
  • Major software updates

I will take reasonable care when performing technical work, but no technical environment is completely risk-free.

16. Existing Websites & Code

When working on an existing website, the website may contain:

  • Poor-quality code
  • Outdated plugins
  • Deprecated functions
  • Theme modifications
  • Custom code
  • Database problems
  • Security vulnerabilities
  • Compatibility issues
  • Previous developer modifications

I may identify issues that were not part of the original request. Where those issues affect the agreed work, I will communicate them where reasonably possible.

Additional work may require a separate agreement.

17. Third-Party Services & Software

Many websites depend on third-party products and services, including:

• WordPress plugins
• WooCommerce addons
• Themes
• Hosting providers
• Payment gateways
• CDN providers
• Email providers
• External APIs
• Analytics platforms
• Security services
• SaaS applications

I do not control third-party providers. I am therefore not responsible for their outages, policy changes, pricing, API changes, bugs, account restrictions, licensing requirements, or discontinuation of services.

I will make reasonable efforts to identify and troubleshoot third-party-related problems when they are within the agreed scope.

18. WooCommerce & Payment Integrations

For WooCommerce projects, I may develop or troubleshoot: checkout, cart, orders, products, shipping, taxes, payment integrations, webhooks, APIs, emails, extensions, and WooCommerce configuration.

However, payment authorization and transaction processing are controlled by the applicable payment provider. I cannot guarantee:

  • Payment approval
  • Transaction authorization
  • Fraud approval
  • Payment-provider availability
  • Provider account approval
  • Provider-side API behavior
  • Provider compliance decisions

19. Emergency Services

Emergency support may include urgent troubleshooting of: website downtime, 503 errors, 504 errors, critical errors, WooCommerce failures, payment problems, server resource problems, malware, hacked websites, and performance problems.

Emergency support does not guarantee that every issue will be resolved immediately. Response and resolution times depend on:

  • Problem complexity
  • Severity
  • Website condition
  • Required access
  • Hosting environment
  • Third-party systems
  • Availability of backups
  • Client cooperation

20. Malware & Security Services

Where malware removal or hacked-website recovery is provided, reasonable efforts may be made to:

  • Identify malicious code
  • Remove malware
  • Investigate suspicious files
  • Investigate malicious redirects
  • Identify compromised accounts
  • Address known vulnerabilities
  • Improve security configuration

Security incidents can be complex and may involve previously unknown vulnerabilities. Therefore, I cannot guarantee that a website will never be compromised again.

Clients remain responsible for maintaining: secure passwords, updated software, valid licenses, secure hosting, and appropriate access controls.

21. Website Performance

Performance optimization depends on many factors, including: hosting, server resources, code, plugins, themes, images, database, APIs, traffic, third-party scripts, CDN, and network conditions.

I do not guarantee a specific:

  • PageSpeed score
  • Lighthouse score
  • GTmetrix score
  • Core Web Vitals result
  • Loading time

unless a specific measurable target has been expressly agreed in writing.

22. SEO Services

SEO results are affected by search engines, competition, algorithms, content, website authority, technical factors and many external variables.

I do not guarantee:

  • #1 rankings
  • First-page rankings
  • Specific traffic
  • Specific leads
  • Specific revenue
  • Permanent rankings
  • Guaranteed indexing

SEO Services are provided according to the agreed scope.

23. Content & Client Materials

The client is responsible for ensuring that materials supplied for the project are accurate and lawful. This includes: text, images, logos, videos, product information, customer data, trademarks, and documents.

The client represents that they have the necessary rights or permissions to use those materials.

24. Intellectual Property

Unless otherwise agreed in writing, the client retains ownership of materials supplied by the client.

Third-party software remains subject to its applicable license. This includes: WordPress, WooCommerce, plugins, themes, libraries, frameworks, fonts, APIs, and open-source components.

Custom work created specifically for a project will be handled according to the applicable project agreement.

25. Open-Source Software

Some Services may use open-source software. Open-source components remain subject to their respective licenses.

Nothing in these Terms transfers ownership of third-party open-source software.

26. Revisions & Change Requests

Where revisions are included in the project scope, they must remain reasonably related to the original requirements.

A significant change to the design, functionality, structure, technology, requirements, or integrations may be treated as additional work.

27. Client Delays

Project timelines may be affected by delays in receiving: content, access, feedback, approvals, credentials, licenses, or third-party responses.

If work is delayed because required information or access has not been provided, the original delivery estimate may need to change.

28. Project Approval

The client is responsible for reviewing completed work.

Approval may be communicated through:

  • Email
  • Written message
  • Project-management platform
  • Freelance platform
  • Formal acceptance
  • Payment
  • Publication or use of the delivered work

Specific project agreements may establish different acceptance procedures.

29. Cancellation

Either party may request cancellation of a project.

If cancellation occurs after work has started, payment may remain due for work already completed. Third-party expenses already incurred may also remain payable where applicable.

The treatment of advance payments will depend on:

  • The agreed project terms
  • Work already completed
  • The applicable refund policy
  • Applicable law

30. No Guarantee of Business Results

My Services are intended to provide technical, development, design, optimization or consulting outcomes within the agreed scope.

They do not guarantee:

• Increased revenue
• Increased sales
• Increased customers
• Increased traffic
• Increased conversions
• Business growth
• Advertising performance
• Search rankings

Business results depend on many factors outside my control.

31. Acceptable Use

Clients may only request Services for systems, websites, accounts and data they are authorized to access and manage.

I will not knowingly assist with:

  • Unauthorized access
  • Credential theft
  • Malware deployment
  • Fraud
  • Attacks against third-party systems
  • Unauthorized security testing
  • Illegal activity

Security-related work must be properly authorized by the relevant owner or authorized administrator.

32. Confidentiality

I will take reasonable steps to protect confidential project information provided to me. This may include: business information, website credentials, technical information, private project information, non-public documentation, and client information.

Confidentiality does not apply to information that:

  • Is publicly available
  • Was already lawfully known
  • Becomes public without breach
  • Is independently developed
  • Must be disclosed by law

A separate NDA may be used where additional confidentiality obligations are required.

33. Personal Data

Personal information submitted through this Website may be processed for purposes including: responding to inquiries, providing Services, managing projects, communicating with clients, processing payments, maintaining business records, and complying with legal obligations.

34. Website Security

Reasonable measures may be taken to protect the Website and project information. However, no online system can be guaranteed to be completely secure.

You should not transmit unnecessary sensitive information through ordinary website forms or email.

35. Website Availability

I aim to keep the Website available and functional but cannot guarantee uninterrupted availability.

The Website may occasionally be unavailable because of: maintenance, hosting issues, technical failures, security incidents, network problems, software updates, or circumstances beyond reasonable control.

36. Third-Party Links

The Website may contain links to third-party websites. I do not control those websites and am not responsible for their content, security, availability, privacy practices, terms, products, or services.

Your use of third-party websites is subject to their own policies and terms.

37. Website Content Disclaimer

Information published on this Website is provided for general informational and professional-service purposes.

Although reasonable efforts are made to keep information accurate, I do not guarantee that all information will always be complete, current, error-free, or suitable for every situation.

Technical recommendations should be evaluated in the context of the specific website and environment involved.

38. Limitation of Liability

I will provide Services with reasonable professional care.

To the maximum extent permitted by applicable law, I will not be liable for indirect, incidental, special, consequential or similar losses arising from the use of the Website or Services. This may include, where legally permitted:

40. Dispute Resolution

If a dispute arises, both parties agree to first attempt to resolve the matter through good-faith communication.

Where appropriate, the parties may attempt:

  1. Direct communication
  2. Negotiation
  3. Mediation
  4. Another mutually agreed resolution process

Nothing in this section prevents either party from seeking legal remedies available under applicable law.

41. Governing Law

These Terms shall be interpreted in accordance with applicable law.

The appropriate governing-law and jurisdiction provisions may depend on the legal structure and location of the Service Provider, the location of the client, and mandatory laws applicable to the transaction.

For international clients, mandatory consumer or other applicable laws may provide rights that cannot legally be excluded by these Terms.

42. Changes to These Terms

I may update these Terms from time to time. The current version will display the applicable Last Updated date.

For existing projects, the project-specific agreement applicable at the time of engagement may continue to apply where appropriate.

43. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.

44. No Waiver

If I do not immediately enforce a provision of these Terms, that does not mean that I have waived my right to enforce it later.

45. Entire Agreement

These Terms, together with the applicable proposal, quotation, statement of work, invoice, NDA, written project agreement, and approved scope changes, form the agreement governing the applicable Services.

If a project-specific written agreement contains terms that conflict with these Terms, the project-specific agreement may control for that particular project.
